Supreme Court Extends Vikas Yadav’s Interim Bail

The Supreme Court of India on Monday extended by one week the interim bail of Vikas Yadav, who is serving a 25-year sentence in the high-profile 2002 Nitish Katara murder case. The extension was granted on medical grounds, continuing a pattern of temporary relief given to the convict in recent months.

A bench comprising Justice M M Sundresh and Justice N Kotiswar Singh was scheduled to hear Yadav’s plea. However, Justice Singh recused himself from the proceedings, leading to the matter being reassigned to a different bench. Justice Sundresh informed the lawyers that the case would now be listed before another bench once orders were passed by Chief Justice B R Gavai.

Background of the Case

The Nitish Katara case has remained one of the most widely followed criminal cases in India. Nitish Katara, a young business executive, was murdered in 2002 in Ghaziabad. The killing was reportedly motivated by his relationship with Bharti Yadav, sister of Vikas Yadav.

The Delhi High Court convicted Vikas Yadav, along with his cousin Vishal Yadav, sentencing them to 25 years in prison without remission. The court observed that the crime was carried out in a “brutal and planned manner” to protect family honour.

The case has since gone through multiple legal battles, appeals, and bail hearings, drawing public attention each time it surfaces in court.

Interim Bail History

The Supreme Court has repeatedly extended interim bail for Vikas Yadav, largely on grounds related to his mother’s health condition.

  • On July 29, Yadav was first granted interim bail by the apex court.
  • On April 24, the court allowed him bail until May 8 under strict conditions.
  • The court also directed that his ailing mother be admitted to AIIMS, New Delhi, for evaluation by a panel of doctors.

Conditions of Bail

He also had to furnish a bail bond of 1 lakh with one surety of the same amount. Furthermore, the apex court directed the Uttarakhand Police and Delhi Police to ensure the safety of witnesses and Neelam Katara, Nitish Katara’s mother, during his bail period.

These measures underline the court’s caution in preventing any possible intimidation of witnesses or compromise in the integrity of the trial’s outcome.

Justice Singh Recuses From Case

The latest development in court was Justice N Kotiswar Singh’s recusal from hearing the matter. No specific reason was cited, but recusals are not uncommon in sensitive cases, often linked to personal or procedural grounds.

Following his decision, Justice Sundresh noted that the matter would be reassigned by the Chief Justice of India. Until then, Yadav’s interim bail has been extended by a week.
