SC Declines Vikas Yadav’s Bail Extension Plea
The Supreme Court of India on Monday refused to extend the interim bail of Vikas Yadav, convicted in the Nitish Katara murder case. Yadav had been out on bail since April to take care of his ailing mother. He later sought an extension, citing his wedding scheduled for September 5.
However, a bench of Justices M.M. Sundresh and Satish Chandra Sharma made it clear that the plea should be placed before the Delhi High Court, where the matter is already pending. The court noted that it would not be appropriate for the apex court to interfere in an interim order issued by the high court.
Senior advocate S. Gurukrishna Kumar, representing Yadav, urged the court for a four-day extension so that his client could file the required application in the high court. The bench firmly declined the request, stressing procedural propriety.
Katara Family Opposes Special Treatment
The counsel representing Neelam Katara, mother of Nitish Katara, opposed Yadav’s plea. She argued that Yadav had been out on interim bail since April 24 and should not receive special privileges.
“Like every other convict, he must surrender and apply for furlough through proper channels,” her lawyer told the court.
The family has consistently maintained that the convicts should not be granted exceptional concessions, as the case has already dragged on for over two decades.
Yadav Cites Health, Wedding, and Fine Payment
Vikas Yadav, now 54 years old, has completed 23 years of his life sentence. He told the court that he needed time outside prison to arrange the ₹54 lakh fine imposed on him at the time of sentencing.
He has also challenged the denial of remission before serving 25 years in prison. Yadav argued that until the court decides on his remission plea, he should be allowed bail.
Despite these arguments, the Supreme Court directed him to pursue relief before the Delhi High Court, where his plea challenging the sentence is currently pending.
Background: The Nitish Katara Murder Case
The Nitish Katara murder case dates back to 2002 and remains one of India’s most high-profile honor killing cases. Nitish Katara, a 23-year-old businessman, was murdered by brothers Vikas Yadav and Vishal Yadav.
Investigators found that the motive was Nitish’s relationship with Bharti Yadav, their sister. The family allegedly disapproved of the relationship due to caste and social status differences.
Both brothers were convicted and handed life sentences. The case became a landmark in India’s fight against honor-based crimes, drawing widespread media and public attention.
The Road Ahead
With the Supreme Court’s refusal, Yadav will now need to file a fresh plea before the Delhi High Court for any relief. Until then, his interim bail stands canceled.
The decision has been welcomed by victims’ rights advocates, who argue that long-term convicts should not be given repeated bail extensions unless exceptional circumstances demand it.
Meanwhile, the Katara family continues its fight for justice, more than two decades after Nitish’s death.
