ECI Resolves Symbol Dispute for Mamata All India Trinamool Congress

The Election Commission of India allocated the name Mamata All India Trinamool Congress to the group led by former West Bengal Chief Minister Mamata Banerjee. The poll body also awarded the Football Player symbol to her faction.

Meanwhile, the rival rebel group led by Arup Roy received the name Democratic Trinamool Congress alongside the Envelope symbol. Both political entities now hold recognized party status across West Bengal, Tripura, and Meghalaya for the current election cycle.

This ruling followed an emergency order freezing the parent name All India Trinamool Congress and its iconic Flowers & Grass symbol. The poll body stepped in after both factions submitted competing nomination papers for upcoming legislative and parliamentary by-elections.

Detailed Bypoll Candidates and Form-B Allocations

Assembly / Lok Sabha Seat Mamata Group Candidate (Football Player) Rebel Group Candidate (Envelope)
Rejinagar Assembly (West Bengal) Rabiul Alam Chowdhury Safiuzzaman Saikh
Nandigram Assembly (West Bengal) Sanchita Pradhan (Dey) Ehteshmul Haque
Nagaon Lok Sabha (Assam) Abdul Salam Uncontested by rebel Form-B

The immediate trigger for the regulatory intervention involved conflicting Form-B nomination submissions. Returning officers reported that candidates from both sides filed papers under the original party banner.

At Rejinagar, Rabiul Alam Chowdhury filed under authorization from Mamata Banerjee. However, Safiuzzaman Saikh presented credentials signed by Arup Roy for the same seat.

A similar standoff emerged in Nandigram, where Sanchita Pradhan (Dey) represented the Mamata group and Ehteshmul Haque represented the Roy camp. To avoid rejecting both candidates, the commission exercised its powers under Article 324 of the Constitution to create distinct party identities.

Legal Framework of the Leadership Dispute

Legal Instrument Statutory Mechanism Purpose of Action
Article 324 of Constitution Residuary Powers of Poll Body Prevents nomination rejections and ensures voter choice
Paragraph 15, Symbols Order 1968 Dispute Settlement Procedure Determines ownership of parent party name and symbol
Section 36, Representation of People Act Nomination Scrutiny Governs valid candidate registration by returning officers

The poll panel clarified that this interim arrangement keeps both groups on equal footing during the electoral battle. Formal proceedings under Paragraph 15 of the Election Symbols Order will determine final party ownership.

The controversy began when internal dissent questioned the legitimacy of the National Working Committee. Rebel leaders argued that executive terms had expired, rendering post-2025 appointments invalid.

The Mamata All India Trinamool Congress group dismissed these claims. They cited party constitutional amendments previously filed with election authorities. The poll body will examine evidence from both sides before issuing a permanent verdict.
