Online Gaming Bill Passed in Parliament Amid Opposition Protests

Law sparks nationwide debate over online money gaming ban

NEW DELHI : Parliament on Friday passed the Promotion and Regulation of Online Gaming Bill, banning the operation, facilitation, and advertising of online games involving money. The legislation was cleared by a voice vote in the Rajya Sabha, a day after its passage in the Lok Sabha, despite strong protests from the Opposition.

Opposition Slams Lack of Debate

The Opposition staged loud protests, alleging that the bill was pushed through without proper discussion. Leader of Opposition Mallikarjun Kharge criticized the government for not allowing a debate, while several MPs demanded a detailed review of the bill’s provisions.

Union Minister Kiren Rijiju countered these claims, arguing that continuous disruptions by Opposition parties had made it impossible to hold meaningful discussions. Alongside the gaming bill, the Opposition also sought a debate on the Election Commission’s special revision of electoral rolls in Bihar.

Strict Provisions Against Online Money Games

The legislation introduces stringent penalties for online betting and gambling platforms, including fantasy sports, online poker, rummy, lotteries, and other money-based games.

  • Imprisonment: Up to three years
  • Fine: Up to ₹1 crore for operating or facilitating money-based games
  • Advertising ban: Jail term up to two years or fine up to ₹50 lakh for promoting money games
  • Financial facilitation: Banks or financial institutions enabling such transactions can face three years in prison and fines up to ₹1 crore
  • Repeat offences: Harsher penalties with imprisonment between three to five years and fines up to ₹2 crore

The bill also prohibits banks and payment companies from transferring funds linked to online betting or gambling platforms.

Government’s Stand on Online Gaming Ban

Tabling the bill, Electronics and IT Minister Ashwini Vaishnaw compared online gaming addiction to drug abuse. He warned that powerful lobbies behind online games might challenge the law in courts and use social media campaigns to influence public opinion.

“The impact of these money games is dangerous. We have seen how the money earned is often used for illegal activities and even terror funding,” Vaishnaw said in Parliament.

The government maintains that the ban is necessary to protect vulnerable users, particularly young players, from financial exploitation and addiction.

A Blow to India’s Online Gaming Industry

India’s online gaming industry, valued at billions of dollars, has grown rapidly in recent years. Platforms offering fantasy sports, poker, and rummy had attracted millions of players and significant investments.

However, critics argue that the new bill could stifle innovation and discourage legitimate businesses operating under regulated models. Industry stakeholders are also concerned about potential job losses and a decline in India’s gaming startup ecosystem.

Public and Legal Reactions Expected

Experts believe the bill is likely to face legal challenges, with gaming companies expected to contest its provisions in the Supreme Court. Public opinion remains divided, as many parents and activists welcome the ban, while gamers and entrepreneurs fear its impact on the growing sector.

With this legislation, India has taken one of the toughest stances against online gambling globally. Whether the law will curb addiction and illegal betting or push the gaming industry underground remains to be seen.
