Twitter’s Bluebird Logo in Legal Limbo: Startup Seeks Trademark Reversal

Operation Bluebird, a newly established startup consortium, has submitted a petition to the USPTO requesting the revocation of X Corp’s trademarks for Twitter and Tweet, contending that Elon Musk’s company has effectively relinquished the traditional Twitter brand following its rebranding to X.

According to Reuters coverage of the filing, the startup asserts that the original Twitter name, its terminology such as “tweet,” and the emblematic bluebird logo have all been entirely eliminated from X’s products, services, branding, and marketing efforts. Since these elements are no longer present in any functional or commercial capacity, the petition contends that this satisfies the legal criteria for trademark abandonment, which necessitates discontinued use and a lack of intent to resume use.

According to Ars Technica, Operation Bluebird intends to establish a new social networking platform named Twitter.new if the petition is successful. The venture is aiming for a prospective launch in late next year and has already created a functional prototype. It has also started permitting users to reserve identities, indicating that preparations for a public launch are already in progress despite the prevailing legal uncertainties.

Michael Peroff, the Illinois-based attorney spearheading the initiative, remarked that although numerous Twitter-like platforms have emerged following Musk’s acquisition—including Threads, Mastodon, and Bluesky—none have attained the same level of influence as the original platform. “We have not yet observed anything that rivals the scale or cultural influence of the former Twitter,” he stated, highlighting the gap that Operation Bluebird aims to address.

Stephen Coates, Peroff’s collaborator and former general counsel of Twitter, stated that the objective is to reestablish the traditional town square atmosphere that characterized Twitter at its zenith. He articulated the goal of revitalizing an authentic real-time communal experience in which journalists, celebrities, and ordinary users interact with global events as they occur.

Trademark specialists warn that the forthcoming course of action for Operation Bluebird presents significant challenges. The startup must demonstrate that X has entirely relinquished the trademarks and that any minimal or symbolic use by Musk’s company would be insufficient to preserve ownership. Despite these challenges, Operation Bluebird remains dedicated to restoring the legacy brand and establishing a platform that reflects the qualities many users still associate with the earlier Twitter era.
