Patna 4th Dec 2024 : In a significant legal development, the Patna High Court has delivered a major verdict in favor of retired judge Sudhanshu Kumar Lal, who had previously presided over the fodder scam case as the CBI special judge. The court has canceled a controversial 2009 order that had suspended his super time pay scale for one year, a decision that directly impacted his pension and retirement benefits. However, the court did not offer any relief in a separate case involving the judge’s actions during his tenure as District Judge in Begusarai.

The division bench of Chief Justice KV Chandran, after hearing arguments from all parties involved, ruled in favor of former judge Lal by annulling the Patna High Court administration’s order dated December 7, 2009. The 2009 order had suspended Judge Lal’s super time pay scale for a year due to disciplinary action taken against him in 2004. This suspension led to a reduction in his pension and retirement benefits, affecting his financial entitlements after retirement.

The disciplinary action had been initiated in February 2004 when Sudhanshu Kumar Lal was accused of two main charges: first, leaving his headquarters without proper permission from the High Court administration, and second, attending the swearing-in ceremony of a new Patna High Court judge without prior approval. These charges were linked to allegations of misconduct, which led to the administrative punishment.

However, during the hearing of his petition challenging the 2009 order, senior advocate Jitendra Singh, representing Judge Lal, argued that the evidence against him was insufficient and flawed. Singh pointed out that no witnesses had been presented to substantiate the claims of misconduct. According to him, the charges were based on unverified allegations and were, therefore, illegally upheld, leading to his unjust punishment.

The Patna High Court, after examining the arguments, found merit in Judge Lal’s petition and decided to cancel the 2009 administrative order. The court also directed the Registrar General of the High Court to recalculate Lal’s pension and retirement benefits, ensuring that the super time pay scale was reinstated in his service records.
