In a troubling twist in the Justice Yashwant Varma cash scandal, sources close to the Supreme Court-appointed in-house enquiry committee have confirmed that a significant amount of cash recovered from the judge’s residence mysteriously disappeared before an official probe could take place. Staff members at the Delhi High Court judge’s home are now under scrutiny for their alleged involvement in the removal of the money.

Supreme Court Panel Confirms Cash Recovery After Fire

The controversy began after a fire incident on March 14 at the Delhi residence of Justice Yashwant Varma, then a serving judge of the Delhi High Court. During the subsequent inspection of the premises, a substantial amount of cash was reportedly discovered in one of the rooms.

According to the in-house enquiry committee appointed by the Supreme Court, the room was locked and had to be forcibly opened. However, by the time the investigation began, the burnt and partially destroyed cash had already “disappeared”, casting a shadow over the integrity of the scene and prompting serious concerns about tampering with potential evidence.

Misleading Statements and Defiance

Sources revealed that Justice Varma allegedly provided misleading and inaccurate statements when questioned about the incident. The lack of transparency and contradiction in his responses significantly influenced the committee’s findings.

The committee subsequently recommended Justice Varma’s removal from the bench, citing the gravity of the misconduct and obstruction of justice. Despite this, the judge has remained defiant. In a formal response addressed to Chief Justice of India (CJI) Sanjiv Khanna, Justice Varma refused to step down, maintaining his innocence and denying any personal connection to the cash.

He claimed that the room where the money was discovered was “accessible to everyone”, and termed any suggestion that the cash belonged to him as “utterly preposterous.”

President and PM Informed After Refusal to Resign

Under the House enquiry procedure for High Court judges, a refusal to resign following serious misconduct is a rare but significant escalation. This compelled the CJI to escalate the matter to the highest constitutional authorities—President Droupadi Murmu and Prime Minister Narendra Modi—by forwarding the enquiry report along with Justice Varma’s written response.

This process is initiated only in exceptional cases where a judge refuses to step down despite damning findings by the in-house committee.

Swift Action by Judiciary: Transfer Without Judicial Role

Following the initial incident and findings, Delhi High Court Chief Justice DK Upadhyaya launched a preliminary enquiry. Justice Varma was immediately stripped of all judicial responsibilities, and in a subsequent move, he was transferred to the Allahabad High Courtbut without being assigned any judicial work.

While such transfers are often procedural, the timing and the context have sparked intense debate about transparency, accountability, and ethics within the Indian judiciary.

Ongoing Scrutiny and Public Reaction

This high-profile scandal comes at a time when public trust in judicial integrity is under increasing pressure. With staff now suspected of being involved in the removal of critical evidence, legal experts have raised concerns over possible collusion or coercion within the judge’s domestic and professional environment.

Legal observers are closely watching how the judiciary handles the matter in the days to come, particularly in terms of criminal proceedings or disciplinary actions against staff allegedly involved in tampering with evidence.
