These new rules prioritize justice over punishment, with a special focus on women and children: DGP PRASHANT KUMAR

DGP Prashant Kumar gave information about three new laws, With the three new laws coming into effect from July 1, In addition, the colonial laws of the British Raj will come to an end. At present, cases will be registered as per the old laws till June 30.

The new laws have provisions for strict punishment for crimes against women and children and those who leak papers, The new law emphasizes community service rather than punishment for minor crimes.

DGP Prashant Kumar told journalists about the new laws on Thursday. He said that the investigators will be responsible for every step in this. The Indian Civil Code (BNS) 2023, Indian Civil Protection Code 2023 and Indian Evidence Act (BSA) 2023 focus on providing justice to the victim. The intention of the new law is to provide justice in three years and clear the pending cases.

The emphasis is on quick disposal, moreover Training Sunil Kumar Gupta said that in six sections of minor crimes, finally there is a provision of punishment for the accused to do some community work for a limited period. Furthermore Zero FIR can be lodged in any police station and It will later be transferred to the concerned police station.

For the elderly and disabled in crimes punishable for less than three years, permission from an officer of the rank of DSP or above will be required before arrest. In crimes punishable with punishment above seven years,  forensic evidence will be mandatory and electronic evidence will also be acceptable.

Child safety 

1. Inducing children to commit crimes and involving them in criminal acts is a punishable offense

2. Buying and selling of minor children is involved in heinous crimes.

3. Life imprisonment or death penalty for gang rape of a minor.

4. The statement of the victim will be recorded in the presence of the guardian.

More strictness in crimes against women

1. 20 years imprisonment for gang rape or It can also be a life imprisonment.

2.  Making false promises for sex or concealing identity is now a crime.

3 The statement will be recorded in the presence of a female officer at the victim’s house.

This is what makes the new laws unique

1. Videography will be necessary during search and seizure.

2.Videography of the incident will be safe in digital locker

3. It will be mandatory to submit the investigation report to the complainant within 90 days

4. Information about the arrested person will have to be made public

5.After three days of filing complaint through electronic means then you will be able to go to the police station and sign it.

6.Charges will be framed within 60 days, decision will be taken within 45 days after the case ends.

7. Digital and technical records included in documents, appearance in courts will be possible through  video conferencing.

8. Mandatory decision in 120 days in cases against civil servants.

9. ⁠Reduced custody period for the first time offence, Bail after completing one third of the sentence.
