New Delhi: The Supreme Court on Monday declined to hear the bail plea of former Uttar Pradesh MLA Kuldeep Singh Sengar, convicted in the custodial death of the Unnao rape victim’s father. The top court directed the Delhi High Court to give the matter an “out-of-turn” hearing and conclude it within three months.
A bench comprising Chief Justice of India Surya Kant, Justice Joymalya Bagchi, and Justice N V Anjaria heard Sengar’s petition challenging the Delhi High Court’s January 19 order refusing to suspend his 10-year sentence.
Senior Advocate Siddharth Dave, representing Kuldeep Singh Sengar , argued that the former MLA had already served 7 years and 7 months of the 10-year term.
Solicitor General Tushar Mehta, appearing for the CBI, informed the bench that the main appeal against Sengar’s conviction is scheduled for February 11, and suggested that it could be heard on an expedited, out-of-turn basis.
Kuldeep Singh Sengar Bail Pleas Rejected in Custodial Death and Minor Rape Cases
Sengar was sentenced to 10 years in prison by a trial court in the custodial death case. The Delhi High Court had refused to grant bail on January 18, prompting Sengar to approach the Supreme Court.
In the related minor rape case, Sengar had previously been granted bail by the High Court on December 23, 2025, but the Supreme Court stayed that order on December 29. On January 19, the Delhi High Court also rejected his plea to suspend the 10-year sentence in the custodial death matter.

Kuldeep Singh Sengar has been in custody since April 13, 2018. Along with serving the 10-year term for the custodial death case, he is also serving a life sentence in the minor rape case. Both cases originated from FIRs registered in 2018 at Makhi police station, Unnao, and were heard at Tis Hazari Courts, Delhi.
The incidents date back to June 4, 2017, when the minor rape victim was allegedly lured under the pretext of a job offer and taken to Sengar’s residence, where she was raped. On April 3, 2018, while attending a court hearing in Unnao, the victim’s father was reportedly attacked by Sengar in broad daylight. He was later arrested the following day for alleged illegal possession of arms and succumbed to multiple injuries in police custody on April 9, 2018.
